One of our workers is refusing to undergo annual audiometric testing. He also refused to participate last year, but the company let it go. The worker is a long-term employee who is considered at-risk with respect to noise. Where do we stand?

You first need to establish what the basis for refusal is as there may be a legitimate medical reason.

In the absence of this, you can rely on your statutory duty to ensure safety, which you can use to give the worker a lawful and reasonable direction to submit to the testing. A failure to follow the direction can be grounds for disciplinary action.
