Your questions answered: Are all drivers required to hold a Blue Card?

Please can you advise if Blue Cards are mandatory for all drivers?

The Blue Card training system was established by the TWU and is conducted by the Transport Education Audit Compliance Health Organisation (TEACHO). There is no mandatory requirement under the work health and safety legislation for transport workers to have a Blue Card.

Having said that, persons conducting a business or undertaking (PCBU) have a duty to ensure, so far as reasonably practicable, the provision of any information, training, instruction or supervision that is necessary to protect all persons from risks to their health and safety arising from work carried out as part of the conduct of the business or undertaking.

The PCBU must ensure that information, training and instruction provided to a worker is suitable and adequate having regard to:

  1. the nature of the work carried out by the worker, and
  2. the nature of the risks associated with the work at the time the information, training or instruction is provided, and
  3. the control measures implemented.

While the work health and safety legislation does not prescribe the kind of training required, the Blue Card training may be one type of training to assist a PCBU to discharge its duty of care in respect of training.

If a business does not require or provide Blue Card training for workers, then some other kind/s of training should be provided which addresses the matters set out above in respect of the work being performed by the worker.
