When property developers become nightmare neighbours

SafeWork NSW v Ostar Development Pty Ltd (2025)

Property development company Ostar Development Pty Ltd (Ostar) was engaged to redevelop a site in Arncliffe, New South Wales.

Ostar engaged Wen Architects (Wen) to obtain a Complying Development Certificate (CDC) for demolition works to be conducted at the site and the neighbouring property. The drawings and plans prepared by Wen were provided to SL Certifier Pty Ltd for it to obtain the CDC. As requested by SL Certifier, a structural report was developed, which considered the demolition risks due to the close proximity of the neighbouring walls. On 15 September 2022, the CDC was sent to Ostar and Wen.
