The $100,000 cost of repeated failure to ensure the use of fall protection

The Case

WorkSafe VIC v K1 Homes ID Pty Ltd (2022)

Over a period of 18 months, WorkSafe Victoria inspectors attended the construction site of nine multi-level townhouses operated by K1 Homes ID several times.

On 29 January 2019, the inspectors observed a worker not using fall protection on an internal stair void. In response, five improvement notices were issued, including an improvement notice in relation to a failure to control the risk of a fall from height. That notice was complied with on 12 June 2019.

On 23 September 2019, a worker was observed working at height without fall protection. In response, a prohibition notice was issued preventing access to the area. This notice was complied with on 26 September 2019.
