Mining company and director held to account over defective machine

NSW Resources Regulator, Department of Regional NSW v Young Mining Company Pty Ltd (2026) 

A mining company employed a worker who operated a mineral sorting machine. The machine was connected to a conveyor, the guarding of which had mineral build up. In attempting to investigate a blockage, the worker slipped on the mineral build up, and fell into an unguarded chute that was part of the machine. The worker managed to pull an emergency stop lanyard, but the machine continued to operate. The worker suffered a serious crush injury as a result of being buried by material in the chute.
