Mystery removal of a risk control results in fall from height

The Case

SafeWork NSW v Mirvale Pty Ltd; SafeWork NSW v Ronald Ters (2021)

Ronald Ters is the sole director of Mirvale Pty Ltd, which conducts a business involving the provision of construction services, including residential premises. Mr Ters was responsible for the operations of the business, including managing the site, organising trades, and managing work health and safety on site.

On 7 March 2019, a painting contractor was painting the walls of a 2-storey townhouse when he fell 3 metres from the first floor through a void to the ground below, sustaining serious injuries and rendering him unable to return to work since the incident. The void had been protected by a balustrade that had been removed by persons unknown.
