The Case

WorkSafe Victoria v Makmur Enterprises Pty Ltd (2020)

Makmur Enterprises Pty Ltd (Makmur) is a food manufacturing business that had an item called the mini dim sim machine.

The mini dim sim machine had fast-moving parts, including a belt and two power-driven mechanical arms that moved the dough. The mechanical arms created a danger area that posed a risk of entanglement and crush injuries if body contact was made with the machine while it was in operation. The danger area was unguarded.
