Dismissal for sexual harassment found to be unfair

The Case

Scott Ashburner v St Marys Rugby League Club (2024)

Mr Ashburner, an employee of St Marys Rugby League Club Ltd (SMRLC), was dismissed from his employment after allegedly engaging in inappropriate workplace conduct, including swearing at and sexually harassing colleagues.

Mr Ashburner lodged an unfair dismissal claim with the Fair Work Commission (FWC), alleging there was no valid reason for his dismissal and that procedural fairness had not been followed.
